Terms of Use

These terms are the agreement between you and Pelagus Works LLC for the use of Dashkitty. By downloading or playing the game you accept them. If you do not accept them, please delete the app.

They are meant to be read. There is nothing buried in here, and the short version is this: the game is free, it is paid for by advertising, you may play it as much as you like, and you may not modify it or automate it to fake a score.

Using the game

We grant you a personal, non-exclusive, non-transferable licence to use Dashkitty on devices you own or control, for your own entertainment. That licence lasts as long as these terms do, and it ends if you stop accepting them.

You may not sell, rent, sub-licence or redistribute the app. You may not copy it except as your device does so in the ordinary course of running it.

Fair play

Dashkitty is a score game, so this section matters more than it usually would. You agree not to:

• modify, decompile, reverse engineer or tamper with the app, or run it on a device that has been modified to allow that;
• use a bot, a macro, an emulator or any automated means to play, to generate a score, or to interact with an advert;
• submit a score you did not earn by playing, or present an edited screenshot as a real result;
• deliberately exploit a bug to gain an advantage, rather than reporting it to us;
• interfere with, block or artificially inflate the advertising in the game.

We may remove a score, decline to show one, or stop providing the game to you if you do any of these.

Advertising

Dashkitty is free and is paid for by advertising supplied by Google through the Google Mobile Ads SDK. By using the game you agree that adverts will be shown to you, including full screen adverts between runs and optional adverts you choose to watch in exchange for carrying on a run.

Adverts in Dashkitty are non-personalised. What the advertising collects, and what it does not, is set out in full in our Privacy Policy. Google's own handling of it is governed by the Google Privacy Policy and by How Google uses information from sites or apps that use their services.

We do not control which adverts are shown. If you see one that is inappropriate or misleading, please tell us, and Support explains how.

Purchases

Any purchase in Dashkitty is made through Apple and is subject to Apple's terms, Apple's payment processing and Apple's refund policy. We never take a payment directly and we never see your payment details.

Anything you buy is a licence to use it inside Dashkitty. It has no value outside the game, it cannot be exchanged for money, and it cannot be transferred, gifted or traded to another player. Items and in-game currency bought with real money do not expire.

If a purchase does not arrive, contact us through Support and we will put it right. For a refund, contact Apple.

Children

Dashkitty is not directed at children under 13 and is not listed in the App Store Kids Category. We do not knowingly collect anything from a child under 13, and as our Privacy Policy explains, the app has no mechanism by which anyone can give us personal information at all. If you are under the age at which you can agree to terms like these in your country, please ask a parent or guardian to read them with you.

What belongs to whom

Dashkitty, its name, its artwork, its code and its sound are owned by Pelagus Works LLC, except for the third party work used under licence, which is credited inside the game on the CREDITS screen and in the project's credits file. These terms give you no rights in any of it beyond playing the game.

Availability, and no warranty

Dashkitty is provided as it is. We do not promise that it will always be available, that it will be free of faults, or that it will run on every device or every version of iOS. We may change the game, add to it, or stop offering it, and we may stop supporting older versions.

To the fullest extent the law allows, we make no warranties of any kind, express or implied, including fitness for a particular purpose. Some places do not allow that exclusion, in which case it does not apply to you.

Liability

To the fullest extent the law allows, Pelagus Works LLC is not liable for indirect, incidental or consequential loss arising from your use of Dashkitty, and our total liability to you is limited to the amount you have paid us for the app, which for most players is nothing. Nothing here limits liability that cannot be limited by law.

Apple

Apple requires us to say the following, and it is worth saying plainly:

• This agreement is between you and Pelagus Works LLC only, and not with Apple. Apple is not responsible for Dashkitty or its contents.
• Apple has no obligation to provide maintenance or support for Dashkitty. Support is ours, and it is at dashkitty.com/support.
• If Dashkitty fails to conform to any warranty that applies, you may tell Apple, and Apple will refund the purchase price. To the extent the law allows, Apple has no other warranty obligation.
• Apple is not responsible for any claim you have about Dashkitty, including product liability, a failure to meet a legal requirement, or a claim under consumer protection law.
• If a third party claims Dashkitty infringes their intellectual property, Apple is not responsible for investigating or resolving it.
• You confirm you are not in a country subject to a United States embargo, and that you are not on any United States list of prohibited or restricted parties.
• Apple and its subsidiaries are third party beneficiaries of these terms and may enforce them against you.

Ending it

You can end this agreement at any time by deleting the app. We can end it if you break these terms. The sections about what belongs to whom, warranties and liability survive the end of it.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. Nothing here takes away a right you have under the mandatory consumer law of the country you live in.

Changes

If these terms change we will update this page and change the date at the top. Significant changes will be described here rather than made quietly, and continuing to use Dashkitty after a change means you accept it.
